Terms of Service

1. Acceptance of Terms

By accessing or using HAK Platform ("the Platform"), operated at hakplatform.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and HAK Platform, a software product owned and operated by Jawhra Diqat Almustaqbal Company for General Trading and General Contracting L.L (officially translated as Jewel of the Future Precision General Trading and General Contracting Company Limited Liability), a private limited liability company registered with the Iraqi Companies Registrar under Certificate of Incorporation No. ICR 02-33178, with registered headquarters at Baghdad — Al-Qadisiyah, Sec. 606, St. 8, Bldg. 106, Apt. 8, Republic of Iraq (collectively, "we", "us", or "our").

2. Description of Service

HAK Platform is a business management and AI-powered customer communication platform designed for clinics, stores, and restaurants. The Platform provides:

  • Unified messaging across WhatsApp, Instagram, and Facebook.
  • AI-powered automated customer responses.
  • Business dashboard with analytics and management tools.
  • Public business pages for online presence.
  • Integration with Meta platforms for social media management.

3. Eligibility

To use HAK Platform, you must:

  • Be at least 18 years of age.
  • Have the legal authority to enter into a binding agreement.
  • Provide accurate and complete registration information.
  • Operate a legitimate business (clinic, store, restaurant, or similar).

4. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Ensuring that all information you provide is accurate and up to date.
  • Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or exhibit fraudulent or abusive behavior.

5. Acceptable Use

You agree not to use HAK Platform to:

  • Send spam, unsolicited messages, or bulk messaging in violation of applicable laws or Meta platform policies.
  • Harass, threaten, or abuse any individual or entity.
  • Transmit malware, viruses, or any malicious code.
  • Violate any applicable law, regulation, or third-party right.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Attempt to gain unauthorized access to our systems, other users' accounts, or connected third-party platforms.
  • Use the Platform for any illegal, fraudulent, or deceptive activity.
  • Collect, harvest, or scrape data from the Platform without authorization.
  • Interfere with or disrupt the Platform's infrastructure or other users' access.

6. Third-Party Platform Integration

HAK Platform integrates with Meta platforms (Facebook, Instagram, WhatsApp). By connecting your Meta accounts, you acknowledge and agree that:

  • Your use of Meta services is subject to Meta's Terms of Service and Meta's Privacy Policy.
  • We access your Meta data only with your explicit authorization and for the purpose of providing our services.
  • You are responsible for complying with Meta's platform policies when using our services to interact with customers.
  • We are not responsible for changes, outages, or limitations imposed by Meta on their platforms.
  • You may disconnect your Meta accounts at any time through your dashboard settings.

7. AI-Powered Features

HAK Platform uses artificial intelligence to generate automated responses to customer messages. By using this feature, you acknowledge that:

  • AI-generated responses are based on the information you provide about your business and may not always be perfectly accurate.
  • You are ultimately responsible for the content of all messages sent to your customers, whether AI-generated or manual.
  • You should review and configure your AI settings to ensure responses align with your business practices.
  • AI features are provided "as is" and we do not guarantee specific outcomes from their use.

8. Intellectual Property

The Platform, including its design, code, features, logos, and documentation, is owned by HAK Platform and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our written consent.

You retain ownership of all content you upload or create on the Platform (business information, messages, images, etc.). By uploading content, you grant us a limited license to use, store, and process that content solely for the purpose of providing our services to you.

9. Subscriptions and Payments

  • Access to certain features may require a paid subscription.
  • Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan).
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with at least 30 days' notice.
  • Refunds are handled on a case-by-case basis at our discretion.

10. Limitation of Liability

To the maximum extent permitted by applicable law, HAK Platform and its officers, directors, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of profits, revenue, data, or business opportunities.
  • Any damages arising from your use of or inability to use the Platform.
  • Any damages arising from unauthorized access to your data or account.
  • Any third-party actions, including those by Meta platforms.

Our total liability for any claim arising from your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

12. Indemnification

You agree to indemnify and hold harmless HAK Platform, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party rights.
  • Content you transmit through the Platform.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately, and we may delete your data in accordance with our Privacy Policy.

You may terminate your account at any time by contacting us or through your account settings. Sections of these Terms that by their nature should survive termination will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Iraq, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Iraq.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by posting the revised Terms on this page with an updated "Last updated" date. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
